pretty funny, considering the host, and the clip does a good job of highlighting most of the prominent reasons for legalizing it, along the way.

another good one, is the one i often mention first, because it catches people off-guard if they've never seriously considered it.

can you name one other "crime" where the actions of the people involved are NOT crimes, when taken individually?

it's ok to give a person money. it's legal to have sex with someone. but it's a crime if both happen at the same time. making sex the only thing that's legal when free, illegal when paid for.

still..start the argument in the right place. people should be free to have sex with whomever they want under whatever conditions they want. taxes regulations, etc. are all unnecessary and unjust. you don't need a federal law to mandate condom usage or dick checks...businesses and individuals can and should choose to engage in those same safe practices without government regulation.

you probably use condoms and at least make a quick check for any giant oozing sores when you have one night stands, no reason you shouldn't do it if you were buying a hooker...

I agree that the government should not be in the business of outlawing victimless "crimes".

However, the government can and should require safety precautions because one person's negligence can increase risks to others despite the others' vigilance.

Hmmm - while this is not a view I purport, it is one of which I am aware; some (read: not me) might argue that legalizing a market in sex results in its commodification, which could be argued to have a detrimental effect on our appreciation of, and could diminish our understanding of certain feelings that tend to be associated with, the act. Just playing Devil's Advocate in response to the "there is no downside to legalizing sex" position.

Let's set up a government agency which can set and inspect the businesses to uphold a standard for quality of service aswell as keeping an acceptable working environment. We could even have them form a courtesan's union, ensuring that they've got someone fighting for better working conditions and wages.
This could lead to more jobs, better control over the market and some say in how the business is carried out.

This isn't my words but the words of a colleague who's arguing for the legalization of prostitution. I'm not swayed either way, haven't ever gone to a prostitute and most likely never will.

No, I wish to make blatant recklessness/negligence illegal in cases where it is likely to harm other people. It should be illegal to NOT call in sick when you have the flu, except in extraordinary circumstances. It should be illegal to shag 100 different people without ever bothering to use a condom or get tested for STDs.

After all, the main purpose of government is to prevent people from hurting people.

ever seen minority report? I have to disagree with your interpretation of the role of government. The role of government should be to ensure those who hurt others provide restitution for thier victims. Preventing crime is impossible so why would you design a system around an unrealizable premise? Besides, if a hooker gives me aids and the cops take her to jail...how does that help me and my aids?

Yes, I have seen minority report, and you are conflating two completely separate things. Real crime prevention that happens every day is about setting incentives, not hiring psychics nor punishing hypothetical future crimes. The sole justification for any form of punishment is as a disincentive to crime, not as revenge or restitution. A chief purpose of the entire criminal justice system is to deter crime by punishing criminals who committed crimes in the past and setting up the expectation that new crimes will be punished. It is impossible for the punishment of the offender to take any part of the actual restitution of the victim, unless the punishment involves a transfer of money. The criminal justice system has only two valid roles: deterrence and rehabilitation. Restitution = money transfer = a civil matter.
